This Privacy Policy for Layout Department, made by ANEMONE (“we,” “us,” or “our”), describes how and why we might access, collect, store, use, and/or share (“process”) your personal information when you use the website layoutdepartment.com (the “Site”), the software application Layout Department (the “App”), as well as any other related products and services (collectively, the “Services”).
The key privacy-related thing to note: when using the App, your PDFs are processed locally on your computer and are not uploaded to the internet or servers.
A high level summary of some things that could be of importance to you:
- If you have an error or bug occur during use of the App, information about your computer, error logs, and App settings (but not your PDF’s content) may be sent help us fix issues; unless you turn this off in Settings.
- Downloading the App: a third party hosts the download and software update files and has information about your use (for example, when/where your computer is accessing the downloads).
- If you purchase a paid license: your personal and banking information will be used to process your purchase via a third party provider.
- If you submit feedback, suggestions or questions: you may choose to provide your name, email or other information to us via email or feedback form.
- Interacting with the website: We do not install cookies/tracking such as Google Analytics, however, while on the website our hosting provider can see your usage as part of providing the service and collects data in accordance with their own terms.
- The App checks to see if Spectrolite (a companion app by ANEMONE) is already installed on the same computer, and if it is, a button is added to the App to let the user quickly move their imposed files to Spectrolite.
These are described in more detail in the following sections, and the descriptions below take priority. If you do not agree with our policies, Terms and practices, please do not use our Services.
1. INFORMATION COLLECTION
Personal information you disclose to us: We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.
Information automatically collected: We automatically collect certain information when you visit, use, or navigate the Services. This information may include device and usage information, such as your IP address, browser and device characteristics, operating system, settings and preferences, referring URLs, country, location, information about how and when you use our Services, and other technical information. Paid licenses and bug reports are associated with a cryptographically-hashed version of each computer’s specific identifier. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.
2. PROCESSING YOUR INFORMATION
We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.
3. SHARING YOUR PERSONAL INFORMATION
We may need to share your personal information if required by law.
4. COOKIES AND OTHER TRACKING TECHNOLOGIES
We do not use use cookies or similar tracking technologies (like web beacons and pixels provided by Google Analytics, for example) to gather information when you interact with our Services.
We do track some website and in-app data to maintain the security of our Services, prevent crashes, fix bugs, save your preferences, and assist with basic site functions. Examples include bug reporting (which can be turned off in preferences, and does not include the content of your PDF files) and checking the validity of paid licenses.
We also use third parties and service providers, and these may use online tracking technologies on our Services for analytics and advertising, or otherwise track you. If you would like to review their privacy policies, the third parties and service providers we use include (but are not limited to):
- Paddle, for selling and managing paid licenses and handling financial transaction data.
- Amazon web services for hosting the downloads of the App and checking for and providing updated versions. We remove the access logs of these services after 90 days.
- Netlify for hosting the website.
- Google Workspace, for analyzing and reviewing some of the bug report data and email correspondence with users.
5. PERSONAL INFORMATION
We will use the information we receive only for the purposes that are described in this Privacy Policy or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party providers. We recommend that you review their privacy policies to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.
6. INTERNATIONAL SERVERS
The servers for the App and Site are located in the United States and may also be served from other countries, depending on where you are located. If you are a resident in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. Please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information including facilities in and other countries.
7. RETENTION PERIOD
We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
8. INFORMATION FROM MINORS
We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services.
9. PRIVACY RIGHTS
If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us at contact@layoutdepartment.com. However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent. We may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.
10. UPDATES
We may update this Privacy Policy from time to time. The updated version will be indicated by an updated “Revised” date at the top of this Privacy Policy. If we make material changes to this Privacy Policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this Privacy Policy frequently to be informed of how we are protecting your information.
